These Terms apply to all users of the website, including browsers, members, clients and event attendees.
Clause 03
Acceptance of Terms
By accessing or using www.thebusinesssocial.com.au, purchasing any service or product, or enrolling in any program offered by the Company, you confirm that you have read, understood and agree to be bound by these Terms.
If you are agreeing to these Terms on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms.

User Obligations
When using our website or services, you agree to:

Clause 05
Memberships & Programs
Memberships are offered on a subscription basis. Minimum contract terms (where applicable) are stated at the point of purchase. Cancellation terms are outlined in your membership agreement or at the point of sale.
Mentorship programs (including the Accelerator) are subject to separate program agreements provided at the time of enrolment. In the event of any inconsistency between a program agreement and these Terms, the program agreement will prevail.
Venue hire (Hire HQ) is subject to separate booking terms provided at the time of reservation, including cancellation and bond conditions.
Events and workshops are subject to individual event terms, including refund and cancellation policies communicated at the time of booking.
All programs, memberships and services are provided for business and professional development purposes only. Results are dependent on individual effort and circumstances. The Company makes no guarantee of specific business outcomes.
Clause 06
Payments, Cancellations & Refunds
All prices are listed in Australian Dollars (AUD) and include GST unless otherwise stated.
Payment is required at the time of purchase unless a payment plan has been agreed in writing. Payment plans do not affect the total amount payable.
Cancellations and refunds are handled in accordance with the specific terms applicable to each service or program, which are disclosed at the point of sale. In all cases, your rights under the Australian Consumer Law (ACL) are preserved.
If a service cannot be delivered as described, you may be entitled to a refund, credit or rescheduling at our discretion and in accordance with the ACL. We do not offer refunds where a change of mind occurs after a program has commenced.

All content on this website — including text, images, graphics, logos, trademarks, program materials, templates and resources — is owned by or licensed to Burnt Sky Pty Ltd T/AS The Business Social and is protected by Australian copyright law.
You may not reproduce, distribute, modify, publicly display or use any of our content for commercial purposes without our prior written consent.
Program materials provided to members and clients are for personal use only and may not be shared, resold or distributed without written permission.
Clause 08
Limitation of Liability
To the maximum extent permitted by law, Burnt Sky Pty Ltd is not liable for any loss, damage, cost or expense (including indirect or consequential loss, loss of data, loss of revenue or business interruption) arising from:

Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law that cannot be lawfully excluded.
Where our liability cannot be excluded, it is limited (at our option) to the re-supply of the relevant service or the cost of having that service re-supplied.

Australian Consumer Law
Our services come with consumer guarantees under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot be excluded. If a service fails to meet a consumer guarantee, you are entitled to a remedy.
Nothing in these Terms is intended to exclude, restrict or modify those guarantees.

If a dispute cannot be resolved informally, it will be governed by the laws of Western Australia. Both parties agree to submit to the exclusive jurisdiction of the courts of Western Australia.
For consumer disputes, you may also contact the WA Department of Energy, Mines, Industry Regulation and Safety (Consumer Protection) at www.commerce.wa.gov.au/consumer-protection.
